H1 trouble

Hello All,

I know a lot of similar questions have been asked, but I am unable to get best information.

I got into a consulting company. My employer asked me to pay for my H1 and took $1500 for it. Now that my visa has been accepted, he is not giving me my H1 papers. So now I dont have my H1 or I-94.
He has been paying my pay through cheques. When I tried to ask him for my papers, he threatened me with revoking my H1. I am married and have a family to take care of. So I am unable to I dont have a clue what to do now.

Any help would be appreciated.

This is outrageous, he takes money from you for H-1 (which is illegal) and refuses to give your H-1. My advice will be contact a good attorney and sue him. You can also complain to the labour department. It might cost you some money but you can't live like this. There is no point in working for this employer. You will find some other good employer.

its illegal for your employer to accept payment for h1 processing.
you have the RIGHT to demand them to get you h1/i94. you have even more right to demand as you have paid for that h1.
based on your posting it seems your employer is violating too many laws which will land him in more trouble if you take initiative.

dont discuss anything in phone. demand them to give your ORIGINAL H1 AND I94 in EMAIL. wait for few days. if you dont get any response then email them that its illegal for them to get payment from you for h1 processing and holding your h1/i94 and let them know that you will be complaining to department of labor shortly.

they and their business will be screwed up if you complain to dol. document and communicate everything in email. dont entertain phone conversation at any cost.

threating to cancel your h1 for demanding your rights has serious consequences based on whistle blower protection act and constititional law of usa. if you act wisely your employer will face jail sentence.
