When is the earliest I can start working for a new employer?
My attorney strongly advises me to wait until we receive a receipt notice of filing the H1B transfer petition from the CIS Service Center. The employer wants me to start working as soon as we have a Fed-Ex receipt of delivery of the application. The attorney says this would still represent a risk, since if, for example, there is anything missing in the application, it would not actually have been filed, and, in such a case, I would be working unauthorized. According to the attorney it should take 7-10 days to get a CIS receipt notice, but I also see on these forums that it could take much longer, and that you might even never get the notice, and then get an RFI several months later.
Whom should I listen to?
I really need to start working for the new employer ASAP because I need them to file PERM before December 24. They were only going to file PERM after I have worked there 90 days. Since I will not be able to start on September 23 like I would need to for this to work, they said they would probably still be wiling to file by Dec. 23, but for that reason, I shouldn’t wait for the receipt notice from the CIS, but rather start as soon as we have the FedEx notice. Obviously, this is critical. However, I don’t want to get in an even greater trouble by working unauthorized.
