H1 transfer

Hi couple of questions for the experienced H1ers.

1. I am on a H1 and changing my employers. According to the new or not so new INS regulation the employee can start working as soon as the petition is filed. Is that right?

2. My new employer feels it is safer wait for the WAC number to come through before I start. I am in CSC. Any idea as to how long it takes for the WAC number to be given after filing?

I have a similar situation. My new employer has told me that if the WAC number does not come within 15 days, they will have to rethink on hiring someone else. Although the papers will be posted to INS on Saturday, Sept 21, 2002, I am nervous when the WAC number will come from INS.

I would appreciate a reply from someone in California who has gone thru H1 transfer and knows how long does it take for WAC number to come.
 
Well, my lawyer told me it takes about 1-2 weeks for the WAC to come. I checked with another lawyer too and they said the same thing. But knowing INS, you never know.
Why don't you persuade your employer and tell them that nowhere in the INS regulation does it say that you have to wait for the WAC. It is how you want to interpret it.
My employer is ready to wait.

Should not take that long.

I applied for an H-1 transfer on June 25 and received my WAC number on June 27. I however had to make sure that my company sent all (read complete) paperwork and worked with the lawyer to send it on to INS the same day. Don't rely on Managers to be prompt in this regard and take the initiative yourself.

And yes, it was in California.
