H1 Transfer, please help!!
Hi,
My wife is currently on an F-1 in her OPT period. She got her H1B
applied through a consulting firm. We have a copy her receipt with
the WAC number. This firm seems to be taking no interest in finding
her a project. In the meanwhile she is also trying to look for a job
on her own. I have a few of question:
1) Does her status change to H1 as soon as her H1 is approved?
2) If it does, is she out of status as she does not have a project with
this firm?
3) If she gets an offer from another company and wants to transfer
her H1 to this new company as soon as she recieves the approval,
can she do so even though she hasn't worked with the company that
did her H1? She won't have any pay stubs required for H-1 transfer.
4) I suspect that the old firm might be reluctant to give us the H1
papers. In such a situations what can we do to get the papers. Can
we still transfer the H1?
I would appreciate your assistance.
