First query: I am planning to transfer H1 to a new employer. My old visa stamp has expired and i need to travel to India for a month before joining new employer. Can i go for visa stamping at consulate with H1 transfer receipt notice only? If the notice is valid for starting employment with new employer while in the US, is it valid to get visa stamp as well or i would need the transfer approval notice for that?
Second query: What should be the work start date on the H1 transfer petition? Should it be the day right after my old H1 ends or the day i am actually going to join after coming back from India? Is it true that H1 transfer is valid only if you join immediately after leaving the previous employer otherwise it will have to be presented as a new H1 petition?
