H1 transfer question - Starting work with new company

Hi all,

My wife would like to give notice to her current company only after getting the actual approval from INS, just to be on the safe side. She has applied for premium processing. So, she should receive the approval in a week. Is it legal for her to start working with the new Company before giving notice to her current company?

I don't think so there are immigration legalities.

You have to see the agreement your wife signed with your co., whether it is OK to work at a different place while on their payroll.
 
Thanks. Well, the offer letter does specify a 2 week notice period. Even though on pay roll, she is not being paid now because she is between projects (her next one starts next week with current company). She is hoping they will not insist on the 2 week notice because she is not in the midst of a project.

How long will take for transform H-1b visa

I'd like to know how long will be take for transform H-1B visa from current company to new company? How can we do it? Just like apply new H-1B or anything else? Thank you so much.
 
It takes 3-4 months to transfer the visa. You can start working as soon as you get the receipt that the transfer was filed. You can opt for premium processing which takes 7-15 days. It costs 1000 dollars to do premium processing. Also H1b transfer do not come under the H1b annual quota limit.

Your new company's lawyers should be able to apply for the transfer.
