I'm currently on a H1 visa (I had applied for this H1 when I was in INdia and came here on H4 with my husband & then applied for H1 - I 94 transfer from H4). I'm currently having valid H1 with I 94, I transitioned to H1 2.5 months back, I just applied for SSN and got the SSN # last week. My current employer is finding it challenging to fit any opportunities for me and I have been seeking job by myself. I have an opportunity with a start up company, My question is
1. Will I be eligible for H1 transfer?
2. Do I need paystubs?
3. My current employer does not pay me and I just got my SSN last week, can I just apply for a H1 transfer based on this without a pay stub?
4. Since I have been in this H1 only for the last 2.5 months do I need to show any paystub for H1 transfer?
5. If indeed I need a pay stub for the transfer, how do I convince or request my employer for this? can he legally do this?
