H1 Transfer Help

Hi Friends,

I am worked with Company A till end of May 2003. Then i joined Company B(Current Employer) on June 1st 2003 without any gap and filed H1 transfer with them. After close to 3 months i got my H1 transfer approved through online checking yesterday 08/26/2003. But i have a offer in pipeline with Company C who is willing to transfer H1 B from Current Employer (Company B) immediately. Generally it takes 14 days to get the approval notice from BCIS.

But since the end client who offered me the job through Company C is in a rush.

Question is can i file the H1B transfer with Company C without enclosing the H1 B approval notice but with just only receipt notice. Will i get any kind of RFE?

This is very urgent for me.

Kindly give suggestions and messages with experience.

My friend has the same problem, but his company attorney filed with just the Receipt notice of the pending I-129 petition at same BCIS office and he got it approved with out any RFE

He attached all his paystubs from the beginning of working day for company B (in your case) along with new I-129 application for Company C

I guess you can do it technically , consult your company C attorney and have him/her advise
