H1 Transfer & H4 - Urgent

Hi

I am Working for Company A now, my wifes Appointment for H4 through Company A is on 16 th May, can i apply for a H1 Transfer now, will there be any problem if i do so.

If my H1 is approved Before 16 May then does she needs to carry the New H1 papers or the Company A papers are still valid.

If your wife is on H-4 status, and it is through your previous employer, she will still be on that H-4 visa, and her H-4 will be connected to that particular approval notice (I-797) and I-94 number. However, this also means that when you do your petition change from employer A to employer B, they will probably extend your H-1 visa along with the petition change, and you will probably end up with a late expiration date than your wife, so when your wife's H-4 gets close to expiration, (6 mos or so before expiration), you need to file an H-4 petition for your wife's H-4 to be extended until your H-1 expiration date, based upon your H-1 petition.

Or, you can consider filing her H-4 now, and change her along with you in order to have your paperwork match employers. CIS will not automatically change your wife.
