H1 Transfer but agreement with previous emp

HI;

I have a contract with my previous employer stating that if I leave the company before 1 yr I may have to pay for visa fees + additional cost company has incured coz of me. Now, I am getting a full time perm position in another company and they are ready to apply for visa.

My question is if i agree to pay the amount to the previous company can i transfer my H1?

Can they take a legal action against me even after I agree to pay them the money they ask for?

What is the best way to get the transfer done fast before the previous company revokes my current H1B?

What is the visa fees the company might have paid for me? So that I can know how much I may have to pay them.

Kindly help. Any help would be greatly appreciated.

you are very ignorent. The H1 is sponsored by the employer. You dont have to pay a dime for the processing of H1. thats the meaning of H1.
If your enployer is asking you to payback, ask him in writing. Or email or some sort of proof. He would definitely not give you that.....hay! its illegal to collect money for H1 processing from the employee.

If it comes to the attention of DOL (department of labor) they will file civil penalties and impose fines and suspent all future H1s for at lease a year or so.

so, tell your employer, that you will contact DOL...that would make their mouth shut.
 
Hi guys,

I have just graduated and I am currently on OPT until May 2007. There is a company here that wants to file an H3 training visa for me since they want me to go back to India after the visa expires. They first claimed they want to file an H1B for me but now they changed their mind unfortunately..

However, I want to try to stay in the US and I was wondering if any of you can help me with the following questions:
1)For instance, I get the H3 visa from September 2006 to September 2008, can I still apply for H1b in April 2007 with some other company even though I am on H3 at that moment? Would my status on H3 obstruct me getting H1B visa in any way?
2)If I get the H1B approved with some other company, can I still stay and work with company that filed H3 for me until October 2007 when I get my H1B?
3)Can company that filed H3 for me some time ago find out that I filed an H1B application with some other company ??

Please let me know what you guys think … Any help is welcome.
