Hi

I got my H1 approved on 9th May. notified the old employer on 11th May and gave him notice period till 20th May. The old employer threatens me that he will send lawyer notice, since he hasn't made any money. He used to keep his cut.

He had me sign a doc last year feb 16 that I will work for him for atleast a year, which was over this year.
I will have had to give him back the moving expenses if I would have stoped working before the yar was over.

There is no other document to my knowledge that he could use against me.
I am alone here with no lawyer access, he is trying to scare me, so that he could do away with the apr and till 20th May salary.
I want my salary. and that's why I gave him a notice period for a clean exit.

Please help me, on what grounds can he send me lawyer notice.

Another thing I have changed employers thru the H1 transfer but the client is the same since this project is subcontracted. The subcontracter and the client are eager to keep me.

Can my previous employer harm me in any way, since the client is the same, but it is not his direct cleint.

based on the above statement your employer cannot do anything. let him go ahead and sue you. it will be dismissed in seconds. he just scares you so that you will let go of your current salary.

generally in most of the states an employer is supposed to settle all wage issue within 15 days or by the next routine payroll.

too bad for you. it will harm you if you have signed any noncompete agreement with your employer. all depends on your contract. move wisely.

I agree with saigc.
You can approach the Labor department for your money if he doesnt settle in next payroll. He is basically trying to scare you, so that you will not think of asking him your money.
If you have signed noncompete agreement with your employer then i advice you avoid joining the other employer for the same client.
