One of my friend had done a H1 transfer and joined a different company. Recently he received his H1 transfer approval notice and to his shock he found it did NOT have an I-94 attached to it and it also says that the consulate is Chennai(in Part 4 section of I-129) . Later he found out that his new company attorney had done a blunder in filling up the I-129 Application form by putting that he resides in India and also mentioning the consulate as Chennai, but actually he is doin a h1 transfer from within U.S
Now he has been working with the new company for 3 months now and getting his paychecks.
(1) Is it legal for him to work for the new company without the I-94 in his H1 transfer approval paper ?
(2) If NOT legal, Is there a time limit he can go and get visa stamped in his PP (or) Should he only work for the new employer after getting it stamped rightaway in his PP ?
(3) Will he have problems having his visa stamped in his PP in the consulate ?
(4) Is there any way he can do an AMENDMENT to get a new H1 transfer approval paper with the I-94 citing the mistake of the attorney?
