My wife is going for FMLA leave (maternity) starting next month. She is planning to start working after 3 months. Can she take H1 transfer to another company, if she don't have payslips for last 3 months.

Is it a mandatory requirement to have current payslips for getting a H1 transfer.

Your wife should be able to transfer her H-1B based on her documented FMLA leave and the proper paystubs from before she goes on leave. Make sure that you document properly the FMLA leave and present this documentation with the H-1B transfer.

what do you mean by "document properly the FMLA leave" are there any specific documents we need to fill in and send to (USCIS).

Currently we are filling up a form with current company stating, starting and ending of the leave. Is that document sufficient.

Are you saying - your wife don't have pay slips for last three months and she is going on maternity leave next month? That means she won't have payslips for 4 to 5 months by the time she files a transfer?

No, My wife has payslips now. She won't have payslip starting next month.
The period she will be on maternity leave, we probably won't have payslips.

I came to know some companies gives 0$ payslips. But i don't know now, will we be getting those or not. But right now we don't want to raise that question. We still have one month, i wanted to know what all option we have.

There is no a specific document that you need to have or present - just make sure that the reasons for the leave (FMLA) are in the form or in a letter or something similar.
