h1 transfer after end date of previous job

Has anybody applied for h1-b transfer with similar situation as follows:

Person is laid off on 31st March (H1 is not revoked by employer)and he applied for H1-B transfer with new employer in 1st week of April with paystubs of Jan and Feb only (as he was not paid for month of March)

I saw following link:

Does it mean it is not legal to apply for h1 transfer in above case
 
You may apply for a EOS but ucis may or may not approve it. Or they may approve it without a I94 - you will have to go out of the country and re-enter using the approval notice to be in status.
