My wife is currently doing her first year of residency in Pediatrics and she Currently on H1. Her three year course ends in June/July 2008. But she will be completing her H visa on Dec 01 2007.
I am a software consultant working and have completed my H1 and am currently on L1A Visa for the past several months..
I need some suggestions from the group to ensure that my wife completes her degree on Dec 2007.
Option 1) I have already applied for green card thru a different company and hope that I will get some response pretty soon and my wife's problem is resolved.
Drawback : No idea when will I get a chance to apply for I485.
Option 2) My L1A just started now. As I am continued my stay in US from six years, Will I be having only 1 year which is April 2007 (includes several months of my trip back home)? If not, Can I apply L2 for my wife and get a EAD.
Option 3) My Current company will apply for GC for me pretty soon. Hopefully before April 2006. Then if I change my wife's to L2 can her's stay extend along with my stay so that she can complete her Pediatrics.
My company goes through the proper process and I know that I will get GC. But the only problem is that they take more time as they follow the process. I am not at all positve that they can meet the April 2006 date.
Need your expertise as always.
