H1 to H4 Conversion..........Please Help

Dear Friends,
I am going to india to marry my fiancee this december and want to get her back to US on H-4 VISA. she was on F1 VISA from SEP 2001 to JAN 2005 and she is on H1B since Jan 2005 and she left to India on 2nd August 2005 as her father expired. She is on bench since this January and has no pay checks during her H1B status. I want to go in December and want to marry her and get her back on H4.

1.If she goes to the consulate for H4 stamping will they ask her about her previous paystubs?
2.she has only a copy of I-797 approval notice as her employer didnt give her the original I-797 certificate. is Original I-797 required if she goes for H4 interview?
3.What documents are needed from her side to attend the interview?

do please kindly advice me what is the best way to get her back. I highly appreciate your kind help. I will be waiting for your answer. Ginnu , Great Guru and others..........please send me your views.

Her H4 is totaly dependent on your H1.
they dont ask her if she is applying for H4 abotu her previous H1 status ..
They just look for H4 requested docs .
Pls go throught eh Chennai .Consulate website .. they will mention what are the documents required to get H4 stamped..
Its pretty straight forward if you (On H1) docs are perfect.

As you said I have gone through the Chennai Consulate Website and I have found this

If your spouse is currently working in the US on an H1-B visa, please submit the pay slips for the current calendar year and federal tax returns (IRS Form 1040 and W-2s) for all the years in which he/she has been employed in the U.S. on the H-1B visa.

what should we do? I contacted her employer and he is not willing to produce any documents and not even replying or attending the calls. Is there any solution? friends please send me your valuable suggestions.

OK Here spouse means you ..You are on H1 and you need to submit all those documents in favour of YOu wife H4..

she is applying for H4 right .. does she.. So there is not need to show her previous H1 things .. Now she is dependent .. and her paper work is totaly dependent on your papers...
follow getting H4 division or Paper work for H4..

Thank you very much for your reply. I still have the doubt what do they mean by the spouse its me or her could you please go through these documents needed for H4 dependent VISA which I found from Chennai website

Applicants for the related dependent visas, H-4 and L-2 visas, should submit:

all the required documents for any non-immigrant visa Plus
Your marriage registration certificate, and an original birth certificate for each child.
Your wedding invitation and wedding ceremony photos. Please submit no more than 30 photos. Please do not send entire wedding albums.
All 36 pages of the principal applicant's passport (if not applying with principal applicant). If a copy of the passport is submitted, it should be a GOOD copy and the photo must be clearly identifiable.
A letter from the spouse's employer confirming continued employment.
Copy of the principal applicant's I-797, I-129 and Labor Condition Application (LCA)
Copy of the principal applicant's work experience letters
Copy of the principal applicant's letter of offer from the US company
If your spouse is currently working in the US on an H1-B visa, please submit the pay slips for the current calendar year and federal tax returns (IRS Form 1040 and W-2s) for all the years in which he/she has been employed in the U.S. on the H-1B visa.
