I was recently laid off and my H1 is good till for another 3 weeks. In the meanwhile, I have applied for an H4 visa as a dependent of my husband. I just found out that I will be offered a position with another company tomorrow. The company is willing to process an H1. Will this H1 be considered a transfer even though an application for H4 is pending at the INS? Do I have to withdraw the application for the H4?
