I have a company willing to do anything legally to hire me but I have over 5 years( 6 Year will end on July, 2004) on H1-B and wondering if there are any ways. The company is located in Metro Detroit and Michigan State Labor is processing Sept 2002 (From DOL website, as of July 21, 2003) and Regional(Chicago) is May 2003.

The company has asked me to find if there are any routes they can choose in order to hire me. Please let me know if there are any ways with this kind of time limit. Would appreciate if someone can provide some positive info soon. The attorney they have contacted said 'NO' but I just feel that there has to be a way.

I am an Electrical Engineer (BSEE) with some special skills in Automotive 'Systems' Engineering with close to 6 years of professional experience.

Thanks,

Bipul

There are two ways.............

1) If the company has an approved labor for matching your skills, education and experience, you can file I140 or i140/i485 concurrently.

2) If you were out of US for a significant time (more than a month), you can file for Labor now and recapture the time you spent outside US ( If your labor is spending for 365 days or more, you can extend H1B after 6 years).

Hope it will be useful for you.

Thanks,
Ashkar.
