H1 to F1 transfer

Hi Frnds,

I got H1 visa (transferred frm H4) in Oct,2008 & i m on bench ever since. I applied to a university in Fall 2008(i dont have I20 because i didnt submit financial document), but now i want to defer that admission and change my visa status to F1. The university wants me to fill out an application for that.

What should i mention as my visa status, will it be H1 or H4?

If i mention it as H1, do i have to submit pay stubs while applying for Change of status to F1? (i dont have any pay stubs because i was never on a payroll)

Is it good for me to re-enter US using valid H4 visa & then defer the admission?

Pleasse guys...im looking forward for your help :( :confused:

If your H1 application involved COS and it came with I94 attached to it, then you are on H1 and actually out of status since you did not get paid.
You must get back into H4 status by returning on H4 visa and you should also consult an attorney. For F1 you will first need to obtain I-20 and then apply.
 
thanks for your reply kabkaba.......can i go out of country (canada or mexico) & then re-enter US with my valid H4 stamping....or do i need to consult an attorney before that...
