Say one is on H1 visa and applies for change of status to F1.

Is it needed to maintain valid H1 status (get paid by employer) till the approval is obtained?

Or is it ok that the person is on valid H1 status at the time of filing for change of status to F1?

Generally okay to be in status at the time of filing. But if the change to F1 is denied, then you go out of status since the time you lost the job.

HELP: Advice for H1 to F1 COS

 I'm on H1 and have got admission into a top MBA school (w/ scholarship).

My company filed for the Labor Certifcation for my G.C in late 2002 which is still pending. My questions are -

1. Will this affect the chances of my H1 - F1 COS anymore than it would have had the labor not been filed?

2. Will the intent to immigrate in Form I -539 be yes (or) no?

3. Will it help if I do premium processing for my COS?

Note that I'm gainfully employed. Would appreciate ANY help in this regard. Thanks a bunch.
