H1 to F1 COS filing

My name is Pram Samhen, I live in Orange county NJ.

Here is my case and I am wondering what to do?

I came to USA on F1 in 2007.

My H1 got approved and my status was H1 from Oct 2007.

In 2007 I studied till December 2007, and then I left studies with a thought to complete along with the job. Since H1 approval I didn’t get project from my employer and I am still in the same process. This year I was unable to file taxes as I didn’t get any pay stub thus W2 form was not generated for the year 2008. At present I think I am out of status and my employer not even concern or serious about my employment on H1.

Only best thing which I think I can do is to change the status to F1 by getting I-20 from the college which in turn will also complete my pending studies.

Need in your kind suggestion if you can….also what will be your fees if you handle this case.

You are out of status . You cannot get a COS when you are out of status. You should file a DOL complaint against your employer but that will not cover the Oct 07 - Dec 07 when you were to be working. You have accumulated 19 months of OOS; why are you just now taking care of this?
