H1 to EAD to H1 extension?

Hi,

I have a H1 and EAD question. I am on H1 now which will expire at the end of the year and my company is asking me to extend my H1 now. However, I have applyed for a EAD and expect to get them soon (before H1 expires). What would you suggest? Do I still prefer to extend my H1? Can I still do the H1 extension after I use the EAD for a year or two? I don't want to waste money since my company will not pay for the application.

Depends on what stage your 485 is in.
If your 140 is already approved and its been 180 days past your 485, you *might* get away with not extending your H1.

But as always, keeping your H1 status valid should be your number one priority. Use EAD only after all options have been ruled out.

If you are on EAD and there is some problem with your 485, your status would be in jeopardy and you would have to either leave the US or scramble to find some employer that takes you on H1 -- with the H1 quota issues etc, that may not be possible always.

Personally, I wouldn't worry about the money and will extend my H1 for as long as possible. Finally its ur call.
