Please clarify. In case someone after spending 5 years in US on H1 B come out US for more than a year and GC was never filed during that period, pls. clarify the following:
1) Do we have to file for new h1b or can get extension on the same h1b and for how long?
2) In case new h1b is to be filed then it is considered part of new quota or irrespective of quota again 6 years visa is granted.
In short what is the adv/disadv of staying outside of US with respec to H1B if someone stays out of country for 1 year.
