Hi,
This is an age-old questions..Just wanted to clarify some questions..

Situation : I am in H1B.I will continue to work for another company till i have GC. I want to start an LLC .It's 100% owned by me .I am the only "member".I am planning to have a GC Holder as my company "Manager" . Can i do the following ?

1) Hire a new manager , firing the existing one ?
2) Sign the contractual papers for my company ?
3) Issue paycheck to the employees ?
4) Have my rental apartment(not owned) as the primary company address ?
5) Appoint a Lawer/CPA/accountant to do all transactions on my behalf ?
6) Hire an online firm to do the payroll stuff for me
7) Decide the "manager" after registering the company (after 1 month or so)

Let me know what are the above i can do and which of them i can't .

Thanks..

Provided he has the work authorization to do so...
For example, #3 is something that definitely requires work authorization.
Similarly, #6. That is management, and requires work authorization.
#4 is also critical. Without work authorization, it is best to have a clear separation of personal life and the company to avoid any accusations of working without authorization. With the company office in his apartment, what kinds of checks are there to prevent him doing company management?
Without work authorization, a person can only be a passive investor, and passive investors usually don't have the keys to the company office...

Well, he said that "I am planning to have a GC Holder as my company Manager" . So he can accomplish all the tasks he has mentioned .
