H1 Stamping Visa rejecter if intent to immigrate ( I 140 cleared)

Hello,
 I heard that H1 visas are being rejected these days if there is a definite intent to immigrate ? INS issues H1 visas to potential immigrants because of dual intend, but it seems the embassy rejects the applications because of intent to immigrate.
Any body has similar experience ?

Other than an isolated incidence of a really stupid consular of border officer - not possible

An H visa is dual intent and INS has made it clear that a person may remain in H status even while an I-485 is pending.
