H1- Stamping in Tijuana-Mexico

Hi

I am an Indian. We are planning to go to Tijuana-Mexico for stamping (revalidation) my H1B and my wife's H4 Visa. My first visa got expired in October 2002, and both of us got valid 1-94 till 2005 with our new visa approval. I have some questions.

a) We are planning to go by car

b) Is there any difference between going by car and air?

c) Just incase if they deny the visa,can we re-enter US with the old expired visa and a valid I-94

d) The couslulate web site says, one can no longer re-enter with an expired visa and valid I-94. So I called INS to make it confirm, but they said that we can still re-enter with an expired visa and valid I-94, and they have no idea about the web site.

I heard that the rules have been changed recently. So i am expecting answer from some one who went to Tijuana recently.

A: No it does not make a difference.

A: No you cannot re-enter US with a expired visa and a valid I94
only if you attend the visa office and jour case gets denied.

If you go for a visit then you can come back within 30 days with an expired visa and valid I94 ( applies only to mexico/canada)

A: Yes the web site is correct and look for the answer in case C

Thank you very much for the info. I have one more question. Will they write/stamp anything on the passport if they deny the Visa?

Yes If they deny they do stamp on the last page of the passport (Indicating you appeared for visa) according to some of my friends.

I know a friend of mine passport was not stamped when he applied and they wanted more documentation in canada, he came back without any problem.

Since you are already in the US on H1 the chances of getting rejected is remote ( I would say 1%) as long as you have all the documents.

Don't panic just be confident in answering the questions. It should be easy.

Documents:
1) Employer lettter indicating your salary, position, job desc and the dates you are employed with them.
2) Orginal H1B Approval
3) Copy of your I129
4) Copy of LCA
5) Your paystubs/W2
6) All Degree Certificates and diplomas.
7) Should be able to document all previous statuses in the US

If you have enough time, you can send it for revalidation to St. Louis.(app 3 months)
