4 months ago I started work for a new employer where I was the only Indian they had ever filed an H1 for. We used a good lawyer and it went off smoothly. However, one month into the job the company discovered some financial issues and all employees had to take a 7% pay reduction. I happily volunteered without any thought. I did not file for a new H1 or an H1 update for my job because my profile had not changed (and the fact that my new salary was within the salary band of the job profile of the original filing). However, I am now looking to get my H1 stamped and my question is: when the officer sees my pay stubs would he/she be concerned that my salary on file does not match my pay cut salary? My lawyer has told me there is no need to re-file as long as the cut is in my job-profile-salary-band. Do any of you have any information or advice on this?
