H1 renewal while having EAD

Hi Bhanu, Myladoor and other gurus

My 485 is under processing and both me and my wife have got our EADs. But I am still working on my H1 visa, which is going to expire soon. The question is can I go for my H1 and H4 (my wife) renewal while having unused EAD ? If I am not wrong, maintaining the H1 status will make the life lot easier right (like we can travel abroad without advance parole).

Please let me know your ideas and suggestions.

You are right! Life is lot easier if you have valid H1. And is preffered always.
If you do not have H1 with EAD...
*If any problem like layoff or some problem with GC process, and you
 want to apply GC again your status is illegal.
*If you want to go to INDIA, you have to take AP.

Only advantage with using your wife\'s EAD is she can start working.

In my case, when I spoke with RAjiv Khanna, he suggested to continue on H1 as long as possible.

Thanks for your response. Yes you are right, with EAD my wife can start working. The thing is we both have valid EADs, but I would like to continue on H1 and H4 (atleast my wife starts working). My only concern is that going for H1 renewal will anyway cause problem for 485 processing

I don\'t think going for H1 renewal will cause any problems for the 485 process. One big advantage when you use EAD is that you will save H1 time. So if one year down the line if your 485 is denied, you can have 2 years of H1 if you are on EAD, but if you continue using H1, you will have only 1 year of H1 remaining.

can we infer from these discussions:
if your 485 is pending and your H1 is about to expire, the best thing to do is to renew H1 AND apply for EAD ?
if that\'s the case, how long before H1 expiration, should we apply for H1 extension and for EAD ?

Tom, what kind of document is needed for H1 renewal? Did you start it just like apply for a new H-1?

My first H1 expired on 2/28/01. I applied for renewal on 12/17/2000. Got it approved around 1st week of April. Hope this helps

My company did it for me. They asked me to send
1. Copy of H-1B prior approval notice
2. Copy of College Degree(s)and Transcript(s) (marksheets)
3. Copy of Education Evaluation from earlier H-1B
4. Copy of most recent I-94 card
5. Copy of passport (Old and New) - all pages
6. Copy of Social Security Card
7. Current updated resume

In addition to it you may have to specify you are in 485 stage
