A quick question...any insights appreciated.
I am on H1 with company X. I am on the 8th year extension. The current H1 was valid till Feb 2007. Labor was filed in EB3 in 2002. ANd is still pending, thus allowing for an additional one year extension beyond 2007.
A new opportunity came up with company Y. Owing to the H1 Portability clauses in AC21, I got an extension/transfer of my H1 valid till Feb 2008 (Recapture of time on existing H1 + One year extension). So thats good....
Planning to apply for PERM before Feb 2007. I know this entire process means that my PD is going to be back-logged like anything. But I had my reasons for making the switch to company Y.
Now to my question.....Given that relations between Company X and myself are cordial, is it possible that i can ask them to continue with my existing Labor with PD = 2002? Once that Labor is cleared, can i ask them to continue with the I140? Say that the 140 is approved....
In the meantime, PERM with Company Y will be processed. WHen it is time for me to file 140 with company Y, can i ask for transfer of PD from 2002 (company X) to the current one?
