My H1 petition got approved on June 13th 2005 to start my job on October 1st 2005 while I was doing my OPT over here in the US, but the change of status has been denied at that time. The reason was because my OPT suppose to expire on May 11th and I will be on F1 status until July 10th. Hence I will be out of status after July 10th. INS requested me to leave the US before July 10th and get my visa stampped in my home country.
Instead of going back to my country, I continued my higer degree at my college and remained on F1 status.
Now what's the process to change my status and how long it takes to get it done? I was told that my employer needs to write a letter called I-290A motion reopen-motion reconsider to the INS. Can I start working before I get that approval? Is there any fees to do this?
When I applied for my petition, I used a preminum processing and paid $1000 for it. Does this include to process this document quickly?
