H1 & H4 stamping

Hi Guys,

I am on H1. I recently got my H1 renewed but not yet got the visa stamped in my passport. My wife is in India and preparing to apply for H4. Is it required for me to get my H1 stamped before she approaches for her H4 or can I just send a copy my new I797.


Also I have to send the supporting documentation to her for her H4. Is it ok if I send photocopies of all the required documents (I797, W2 etc) or do they have to be originals. I am reluctant to send the originals. Please kindly advice guys.

You can send a copy of your New I-797. It is not compulsory that you have to get stamped on your passport.

I think photo copies is fine, but send copies notarized by a US Notary.

Can you please tell me , what documents you have prepared and How did you took appointment?Mumbai consulte needs approval before , you can take appointment.

Back in 1999 (well before 9/11) I was already in the US on H1 and because of school exams, my wife & children couldn't go with me for the visa stamping in Mumbai. Later on when they did go, they were asked for my original I797, which I had to send by FEDEX. They brought it back safely of course. I don't know now, but I think that once you have the visa stamped in your passport, and have a valid I-94, then I-797 loses its value. I may be wrong, let some expert in these matters clarify, but this is my personal experience.
