H1-H4 Stamping in Canada- While earlier VISA expired

Hi Folks,
I would very much appreciate your input/suggestions regarding going for H1 and H4 Stamping in Canada. Following is my situation.

Well, this all started with NC DMV not renewing my wife's(on H4) Driving license. They would not renew my wife's license until she either has a valid social security number or have a valid current VISA stamped in her passport.
It is very frustrating...well....

So, the questions I have are:
1. Any Information on VISA stamping experience in Canada who has been recently to Canada for stamping?

2. I don't have a valid H1 stamped on my passport so in case I am denied of H1 and H4(wife) I cannot reenter USA. Any other options here for me?

3. Anybody in similar situation?

i dont think they need Visa stamped in passport. If you show them the valid 797 approval notice, guess that should be enough. Afterall your stay is valid with just approval 797 form.

I thought that should have worked, but it didn't. I talked with their superintendent and got them to give me a letter mentioning the reason of denial. I am going to talk with a lawyer regarding this issue.

I guess this is what making the DMV ask for Valid Visa Stamping

Social Security Number Requirement:
When making application for an identification card, learners permit or drivers license, it is required by law that you provide DMV with a valid Social Security Number, or a valid Visa issued by a US Government Agency, if you are not eligible for a Social Security number. By law, the DMV may disclose a Social Security Number only as follows:

But you can always tell them that i797 is also a valid form of visa and a legal document to stay in US. This is being mentioned under the section Proof of residence..

1) Documents issued by the United States Government or by the government of another nation, such as
Military orders
Valid passport
Immigration and Naturalization Service (INS) documents
Correspondence from Veterans Administration
Matricula Consular from Government of Mexico
Correspondence from the Social Security Administration

In other states like MN, if you cannot have SSN, all you need is a letter from SSN office stating a reason that you are eligibile for SSN.

Just my opinion, i am not a lawyer.
 
Coming back to your question on Canada Stamping, it is same as your home country Stamping need all documents plus you need
1) Canada visitor visa
2) Appointment in Canadian US Embassy.
3) Your previously Stamped visa should be of the same type as the new one you are seeking.

You need to be little careful going to canada if you have a muslim name. One of my co-worker went to Canada and he got stuck their in Background check and FBI name check for more than 2 months. Good for him that he had Canada PR and could stay and work remotely for those 2 months. That is only one case though.

My other co-workers with non-muslim name had no problems, they went and came back in a week's time. I will take atleast 2 days to get your passport back after the stamping. Hope this helps.

Again, I am not a lawyer, these are all just infor that I learnt from others and may not be accurate.

Thank you so very much for all the input. I very much appreciate your time. I will give another thrust for Driver licence in another DMV office. This time I will take printouts of the 'documents requirements' with me as well.

I appreicate your input on getting VISA stamped in Canada. I have a Hindu name so hopefully that should not be a problem.

I have one more question though. A friend yesterday told me that rules recently changed for getting VISA stamped in Canada....that is, if my previous VISA stamped on passport (which expired in 2004) if it is older then one (1) year then I have to go back to India for stamping. Are you aware of this?

There was a 1yr rule similar to the one you have described, When we could Revalidate visa within US.

I am not sure about it wrt to Canada. All of my co-workers went to Canada within one year. Sorry I cannot be of any help.

http://www.amcits.com/usa_visa.asp , try this site, it does not say anything about 1 yr rule. (Search for H1 after the page loads.)

site also has a phone number to talk to, but it will cost few Dollars though. It may be worth it. Let me know what you find.
 
I have recently got my son's permit from DMV. I had to get a letter from Social Security Office saying that H4 doesn't get SSN. Also I had to show them his passport and I-94.

I am going to Canada for H1B stamp in April. They will send you home for your visa stamp only if they cannot validate any of your paperwork from here.I don't think it is an isuue when your stamp expired. You may ask any attorney.
