H1/H4 question

Hi,

I'm new to this forum. Could you please help me with this question.

I'm currently with employer A. I have my visa (both the H1 paper and the stamp in the passport) till mid 2005. My wife's H4 is also having the same dates with the same company. Now I'm planning to change to employer C and sent all my papers. But I haven't sent my wife's. Is this ok, because I was thinking once I get my papers from this employer C, I plan to revalidate my visa and also my wife's. Please let me know if I need to take care of hers now.

But do we get any document like I-797 for H4 too. Or is just the visa stamp in the passport. Please confirm.
 
When you file H4 (Form I-539), you will receive a Receipt Notice from the USCIS which will contain the approximate time frame for it to be processed.
Upon approval,you will receive an Approval Notice which should contain I-94(called Departure Card) with the new expiry date.

Thank you. When I filed for her H4 in India, all that I would get is a stamp. So, now when I change employers, she would get a new H4 document and then again she needs a stamp in the passport, right. Please clarify.

She does not need a new visa stamp if her exixting visa stamp is valid. SHe will only need extension of her H4 status, only if the date on her I-94 is expiring. Otherwise she does not need her H4 extended. Her H4 is not tied to your employer in any way, only to your H1 status. As long as you maintain a valid H1 status, her H4 is valid until her I-94 date.

Thank you guys. With the new revalidation rules, I have to get both our visas stamped in India. The visas are valid for another 10 months from now. I plan to apply for her H4 soon, once I get my H1 papers from the new employer.
