H1/H4 (I94) Extension application while on India Trip

Hi,
I am on H1, and me and my wife's Visa (I-94) are expiring on May 2007.
My company in US had directed me (In Nov 2006) to submit my documents to them (well in advance) so that they could file the Extension petition on time. After i submitted my documents I travelled to India (Currently I am on vacation and in India). My company has filed my extension just now (i.e. while I am in India). I would be returning back to the US in Jan 2007 while my Visa is still valid for another 5 months. Will there be any issues? (Someone from my co. said that I should have informed them about my travel plans as the I-94 extension should be filed while the candidate is in US itself). Will there be any trouble for me while going back? What kind if question they may ask during the immigration?

Also, my wife will be returning by Feb 24th 2007 (And hopefully by then my extnesion papers will be with me). Can there still be any issues?


I am really worried about this :( . Pls. guide me and provide some info.

Hi Vishal,
What I understood from your post is that your company filed for your H1 extension while you are out of country and used your old I-94 (old because, you must have submitted the original I-94 at the airport before leaving USA).

In this case, USCIS (if they catch it) will issue an query (RFE) to your company. Your company has to provide new I-94#, but if you are still in India, then the lawyers has to delay sending your new I-94#. They can send the new number as soon as you get back here.


if you lawyer is smart he would know tricks to delay the reply and still keep the case open.Conclusion, your extension approval would get delayed.

You are right in saying that they used my old I-94 (As it was submitted at the airport itself).

Can there ne any issues while I am returning i.e. at the US airport?
