My wife was on H1 from Oct 2006 - 31 Aug 2009. In July 2009, she changed her status to H4 (via I-539) cauz her contract ended. She went to India in Apr 2010 and got her H4 visa stamped.
1. Can she wants to change back from H4 --> H1 with a new company 'Y' (since she already held an H1b earlier with a different company 'X')
2. If she can come from h4 --> H1 using COS (I-539) then can she start working after the receipt notice or only after H1b approval
Any guidance/advice/past experience with similar situation will be very helpful.
