My 6-year limit on the H1B visa ends in October 2010. Since my husband is on his H1B, I will be changing my status to H4.

I have the option of taking a 1-year sabbatical from my current employer.

If my current employer applies a fresh H1B after my break, can I start working on the new H1B without leaving the US?

You may need to leave US for another H1B.

H1B workers have a general limit of six years of time in H1B status. This may be extended, based upon the filing of a qualifying employment-based Green Card case. Alternatively, individuals who reside outside the United States for one year become eligible for a full six-years of H-1B time. The latter cases are subject to the H1B annual limit or "cap." see http://www.greencardapply.com/question/question10/question10_0508.htm

Thanks for the reply , So my h1b is expiring in NOV 2nd 2010 and assume I leave a day after that and go back India and Try to apply for APRIL 2011 Quota of H1b
can and continue staying in India up till Oct 2011 can i come back in US around Oct 2011 ,
OR
I have to stay In India and apply for the APRIL 2012 H1b Quota ??

Can I Go to H4 VISA and Then In Spring 2011 Join Degree course continue on F1 till 2012 and then have OPT and H1B is that a feasible solution , FYI my wife works on h1B
