Situation:
My wife and I are on H1. My 6 yr H1 term expires on 1 June 2010. I have 21 days to recapture. My company filed my GC labor application on 7 July 2009. To stay with my family, If I am terminated I am considering converting h1 to h4 based on my wife's H1. My wife current H1 is valid upto Sept 2010
Questions:
1) If I convert my status from H1 (before my H1 expires) to H4, what will happen to my labor application? Does it become void?
2)Can I request for a 7th year of H1 extension (after 07 July 2010 when my labour is pending for 365 days or more) from H4 if I find a new employer
3) If my currently employer does not withdraw labor application can my new employer take over my pending Labor application to file for H1 extension after 365 days or more deadline is met?
4)Is it advisableto go outside US given this situation?
