This is probably not a common case. Will make it as short as possible: I came to USA in 2001 as H1B sponsored by company X. Filed my I485 in 2005 and still waiting for my GC. Got a EAD in 2005 and therefore took a job with company Y since it seemed to be a good opportunity. After 6 months with Y, I decided to go back to my original employer X (that was 2 months ago). My H1B expires end of october this year. Got married about 6 months ago and want her with me (she lives in Mexico). Can I get her an H4 as if nothing happened since I'm back to employer X? Any risks? If any, what would the best way be?

Thank you very much.

Have you filled H1 petition with company Y or used your EAD to work with Y?
currently, are you using your EAD with company X or old approved H1?

When I went to Y I just used my EAD. Now that I went back to X we both (me and my employer) thought my old approved H1B should be enough since it hasn't expired so in theory I'm with X under the original H1B. Is this correct?

Thanks for your reply!

I am not sure we can come back on H1 status once we have used EAD. Probably, we have to get fresh H1 stamp to be back on H1 status.
