I am on a H1B visa for 4 1/2 years. This gives me another 1 1/2 years on my 6 yr limit. My spouse who came to U.S a 1 1/2 yr back on a H4 visa, would also get another 1 1/2 yr with me on her H4. This means she would have stayed close to 3 yrs on her H4.
When she applys for her H1, say around the end of the 3 yr period, here are the following questions:
1] Would she be able to avail of the entire 6 yr limit on her H1 though she has already spent 3 yrs on her H4 ?
My understanding was that INS counts the no of years spent in any H classification towards ur 6 yr limit.
2] If the above is true, then would i be able to move to H4 category on her H1 after my 6 yr H1 limit is over and stay for another 6 yrs?
3] If 2nd is true, can i convert to H4 after my 6 yr limit and then stay on H4 for 1 yr and then move back to H1 for my own new 6 yr limit?
Would appreciate if someone can let me know the above
