H1 -H1 transfer or New H1

Hi Guys,

I got laid off, in Oct 2001 due to company closure. Recently I got a new job offer form a different company. The old H1B was valid till April 02.My questions are:

1.0 Will the company have to file for a new H1B?
2.0 If it a new H1B then is it subjected to the Cap?
3.0 What is the position with H1 B cap as of now?
4.0 Do I have to wait for the approval or can I start to work on getting the receipt No.?

raman, can you answer this for me?

raman, how did you resolve this problem? a friend of mine came to the end of her contract at a company and her H-1 is still valid as well (the contracting company hasn\'t informed the INS). but she isn\'t getting paid nor is she an employee of that company any more ... just as though she got laid off.

since her H-1 is still valid, if she finds another job does she have to apply for a transfer? if so, will she be asked to provide recent paystubs? please do let me know how you solved your problem.
