H1->F2

Hi there,

I was just laid off, and my wife is in F1 visa, now I have a question, can I submit the change of status from H1 to F2 immediately in order to keep status? At the same time, I would like to keep looking for a new job, is that ok for me to transfer H1 and after it\'s approved I just cancel the H12F2 application?

H1 petition approved but need to go home for visa

Hi, I was laid off from my previous employer and found a new employer and my H1 has been approved under the new petion but I had 2 and 1/2 month lapse between jobs.Now Immigration is saying I have to go to my country of origin with my H1 approval notice to get the visa stamp.What are my chances of getting the visa stamped.My company is willing to give me all the supporting document.Any recomendation will be appreciated.

Hi,

Have you tried a revalidation which allows you to stay in USA while getting a visa stamp from state dept? Talk to your company lawyer.
