h1 for 2005 question

Hi,

I will be applying for H1 on April 1 2004. My question is does anyone know how the H1 will be processed. I mean will USCIS process the H1 immediately and give me the H1 in april/may with a start date of oct 1 2004 or will the H1's be given in Oct 2004 itself.

h1 and f1 question

I will be applying for H1 on april 1 2004. My OPT is expiring in June which gives me legal stay till August. I am thinkin of applying for F1 just to be legal during the period from August till October. If according to the above reply I can get the H1 by August and I apply for F1 anytime now. What visa will be valid? Say if I get my F1 after the H1 does that mean my H1 will be cancelled? Or will both the visas be valid depending on whether I take up a job or start school?

If you get F1 after H1, F1 will be cancelled. Do F1, wait for approval and then after receiving F1 approval, file F1 to H1.
