My labor cert was filed by my company under RIR at a time when it laid off thousands of employees, The DOL is rejecting all applications from my company on that basis. Therefore my company intends to withdraw my application and file a new one from some other state.
Now, my problem is that my H1 expires in March 2003. If my company files a new application now, it would be in a time frame less than 1 year before my 6 year expiration. So how can I file for an extension ? Can I use the "withdrawn" application to do the same ? Can I ask my company to convert my RIR application to non RIR ?
