H1 Extention with BALCA Appeal

Hi all,

I am due for applying my 8th year of H1 extention soon.

PERM (EB3) filed Mar 2007
PERM denied Sep 2008
In process of Appeal to BALCA

Can someone please let me know what are my options with my H1 extention...Can I file for a new PERM?...

lately DOL are denying 2 perm's by same employer

In case I transfer my H1B to another employer who then files my GC (Labor), does the decision of the BALCA appeal case (especially if appeal is dismissed) have any impact on the new Labor application through the new company.
