H1 extenstion stamping + H4 stamping

Hi,

I came to US in may 2003 with visa till June 2004. Now I have changed my employer and have got a H1B extension and got the petition approved till 2007. I have to go to India in Dec 2004 for my marriage. Hence I need to to get my H1B and H4 for my wife stamped. Please answer the following questions.

1) Can the H1B and H4 stamping take place together or is it necessary to have H1B stamped on my passport before an H4 can be applied?

2) My I-797 does not have any consulate mentioned on it. I want to go to New Delhi for stamping. My first H1B stamping when I can to US took place at Chennai as I was working there. The I-797 has a statement which says "You may file form I824 to notify a consulate of this decision" Do I need to do anything extra (like filing a form I-824 or something) or can I just land in Delhi for my stamping with appointment.

3) Do I need any proof of permanent residence near Delhi or anything like that?

Please clarify.

@@@ Yes both both take place together .. Take a appointment now and include your wife also in that

@@ You can attend Delhi consulate too .. But you have show them why you came to delhi consulate though you are from south india

Actually I am a resident of north india only, my parents permanently reside there. It was just that I was working in Chennai last time when I got my stamping.

Please give any idea of the kind of questions they may ask, or anything else necessary that I may need to do. Or is just giving a north India address enough on forms (Though the address on my passport is a Bombay address).

Any comments on I-824 required or not??

where was your passport issued from if its issued from north india and you still have the address of north india you can go to corresponding consulate ...

i think your passport was issued mumbai since you say the address in your passport is mumbai then you can go to mumbai ...I doubt whether you will be able to get the visa at Delhi ... you might have to come with a very strong reason for visiting delhi consulate else they will ask you to visit mumbai/chennai consulate ...

You dont have to file 824 all the consulate can access the scanned copy of H1 ....they have a centralised database ... it doesnot matter to which consulate in india they send the approval notification to .

My passport was issued in bombay as I was studying there earlier. My last visa was issued in chennai as i was working there. My permanent residence in India is in north India, and thats why I want to go there.....Any comments? does it look like a problem?

Secondly no consulate is mentioned on my petition, so they havent sent notification to any consulate. In such a scenario, is it required to file I824.

I would call US embassy/consulate and find out if they will issue visa or not.

You don't need to file I-824. I had approved H1-B like yours and I got visa stamped in Toronto, Canada (Jan 2004).

Also, kindly post your experience at Delhi in case you do finally go there. I am planning to travel down there in Feb/Mar 2005 and might apply for H1 as well as H4 for spouse.

FYI:

U.S. consular sections in New Delhi and Kolkata started accepting non-immigrant visa applications from applicants residing in the Chennai and Mumbai consular districts on March 22. Interested applicants must schedule their appointments through the website www.ttsvisas.com

Applications will only be accepted from applicants who will apply in person, speak English fluently, have not previously been refused a visa for any reason, and can demonstrate need to travel before an appointment is available at the US Consulate General serving their place of residence. The average wait for an appointment at New Delhi and Kolkata is currently 4 weeks. New Delhi and Kolkata cannot accept e-mail or phone requests for even earlier appointments from persons in Mumbai or Chennai.
