If one had already filed for I-485( also on H1 while filing for 485), and then the PD retrogress backwards, can he/she then ask for a 3 -year extension on the H1. ? The primary reason is for easiness of the H4 approval.

Also, if one already had filed 485 and retrogressed, and exercised EAD ( no more H1 status ) and wanted to bring the spouse to the US, what options are available ?

No

As soon as I-485 is filed you no longer are eligible to extend H1 once 6 yr limit is passed.

Yates AC-21 memo says so. Correct me if I am wrong.

oh., even one year extensions ?, while waiting for the 485 adjucations. ?

where can I get the Yates memo ?

You sure?

485 filed Jan 2004, retrogressed EB3 India. Got approval for 3 year extension (year 7 - 9 on H1) earlier this year.

Ok

I guess I am wrong, that is good to know that you can extend.

As long as your 485 is pending you are eligible to extend your H-1B and there is no limitation on that I believe. I have seen in this forum upto 9 years extension of H-1B (6+1+1+1).
