HI,
I have a few queries regarding my H1 extension. Good news for all
the folks around that premium processing works really good and fast.
My current H1 expires Mar1,2002 and since i had to get my h1 extension done
before i leave for my home country for personal reasons, i wanted to
get my h1 done asap. Hence I applied for premium processing and i got a
notification that it has got approved which is good news.
These are a few queries:
1] Now this new H1 has a start date of Dec,2001 and is valid for only 2 yrs.
When contacted my lawyer, he says that he had requested the extension
for 2 yrs instead of 3 yrs[which would have been done normally] for
strategic reasons for faster approval.
Is there such a thing that one cannot apply for 3 yrs extension if
u do premium processing? I do not understand what he means by strategic reasons.
Pls. educate me on this if anyone around knows about it.
2] Since my current h1 was expiring on mar1,2002 , i was expecting this
new h1 start date to be mar1 or mar2,2002. But it is dec,2001.
THe lawyer says that for premium processing, the start date is the current date
and not the last day of ur current H1.
Is this true?
3]With the above,there is overlap of 2 1/2 months between the current h1 and the extended h1.
Would i lose these 2 1/2 months towards my 6yr limit?
How would the 6 yrs be calculated?.
I entered U.S in June99 and though my current h1 start date is apr99 , i was told that my h1 6yr limit started from June99[since
it starts from the date, one first enters U.S.].
