H1 extension.. Please help

I'm on 7th year H1 which expires in April 2007. My current company filed my LC in 2003 and it is pending in Phily Backlog center
However our jobs will get eliminated and we will be out of work.

My question is If I can get a job with say a company B

1) When company B applies for transfer of H1 visa, till when I will get it.


2) Will I be able to get my 8th year h1 extension. Company B will also apply for Labor throgh PERM.

I have my current pending LC ( with my current company ) screen shots from Dept of Labor

Please answer this.

don't know about 1. but as for 2, from my limited knowledge on this i do remember that company b can file for the 8th year extension based on your lc screen shot.

I think you will get H1B transfer for New company till April 2007. But if your labor is still pending or certified from company A you can get extension for another year from company B.

it is my openion...but you can get expert advice from attorneys.

Hello...i had similar situation last year and USCIS only gave me the new H1 for the reminder of the time I have in my 7th year extension, even though my company and Attorney requested for one year from the date they applied.

So you may get your new H1B only till April 2007 but as you know you never know till you get actual approval papers, they always surprise every one.

You can get your 8th year extension based on existing pending labor certification if prior company does not cancel it.
