H1 extension filing fees

Hello there,

My 6-yr H-1 status expired two months ago, and i am currently in the country on B-2 status. I have since obtained an I-140 approval, and plan to file for reinstatement of my H-1 status for 3 yrs and it will be filed by the same employer for the the same position.

Can my employer pay just the $320 filing fee since this is:
- not an "initial approval"
- a "second or subsequent request for an extension of stay",

I feel there's a slight disconnect on the actual form and i should have been able to check boxes 2(b) and 5(b) in Part 2 of Form I-129. Is this possible with a supporting letter or something?

Hi guys,
Your feeback would be really appreciated - i'm trying to get my employer to file for my extension by Monday, and the less costs i can show him, the better my chances.
