H1 Extension and Labor Pending

Hi Guys,

I am with company A and have applied for my 7th Year Extension on 1st April. I have a EB3 RIR pending through them since April 1st 2004. Now I am getting an offer from company B.

Will I be able to get an 8th year extension based on the new Labor application that company B is willing to file within 4-5 months of I joining them.

What happens if Company A decides not to pursue the Labor application (I am still to get 45 day letter).

Any suggestions will be appreciated.

If company A withdraws you can not use that anymore..

You would have to consider this before making a more..
1. If Company A withdraws the pendign LC - you can not get extensions based (per my knowledge - you can only do based on pending LC)
2. You sould complete 365 days of initial application for LC for you to apply extension (based on Company B LC)

p.s. all based on old rules but not sure with PERM...
